For hours on end, not one of the dozens of people at a special meeting of Oakland’s Public Ethics Commission at City Hall on Monday evening seemed able to discern what Councilwoman Lynette Gibson McElhaney may have done wrong, and why.The dysfunction of the meeting — run by a staff of six political novices who at times lacked an understanding of procedural rules — came to a head when McElhaney’s hired San Francisco lawyer, Jim Sutton, told the commissioners that his client admitted that she was at fault in a series of allegations revolving around pressuring the city Planning Commission to halt construction on five town house units adjacent to her West Oakland home.McElhaney failed to report the assistance as a gift to a public official, and meanwhile took part in council votes to extend and expand JRDV’s city contracts, the staff report said.The ethics commission’s investigation follows a June 2016 Alameda County grand jury finding that McElhaney, then the president of the City Council, had a “material financial interest” in the development planned next to her home, in part because of its location.On the table on Monday night were fining McElhaney about $800, a metric the staff report estimated that JDRV’s consultation was worth, a sum that would have been repaid to the company; fining her a maximum of $15,000; or issuing her a reprimand letter.The ethics commission will revisit the matter in one month, he said, adding that the councilwoman would be open to accepting a settlement she would deem fare, including repaying JDRV for the “gift,” acknowledging receipt of a warning letter or creating a video warning other Oakland government officials about how ethics rules and laws work.
