A federal judge held antiabortion activist David Daleiden and his lawyers in contempt of court Monday for defying the judge’s order by posting videos of conversations secretly recorded at national meetings of abortion providers. The lawyers’ claim they were protecting Daleiden’s right to a fair trial on criminal charges related to the recordings was “a fig leaf to cover their plan to violate the (court order) ... to score a win in the court of public opinion,” said U.S. District Judge William Orrick III of San Francisco. Orrick said they would be required to reimburse the National Abortion Federation, whose conventions they entered, for the added security costs as a result of the inflammatory disclosures as well as attorneys’ fees, sums that add up to $140,000 so far. The Center for Medical Progress issued a statement calling the contempt order “an unprecedented attack on David Daleiden’s rights as a defendant in a criminal case,” the felony charges filed by state Attorney General Xavier Becerra for recording the conversations without consent. Becerra’s office filed criminal charges this March against Daleiden and an employee, Sandra Merritt, under a California law forbidding the secret recording of conversations. After Cooley and Ferreira, Daleiden’s lawyers in that case, obtained the videos from Becerra’s office, links to the conversations and much more — 144 hours of recordings from the conventions — were posted on YouTube by the lawyers and the Center for Medical Progress on May 25.

Valero Energy Corp, the operator of the large refinery in Benicia, sued PG&E following an early May power outage at the plant, a representative said Friday.Valero in the suit is seeking damages of more than $75 million for damage to equipment, lost revenue and other damages following the emergency power shutdown, Reuters reported.Reuters reported that the lawsuit claims PG&E breached its contract with Valero when it allowed both the main and backup power supply to go down at the refinery at the same time, without notice.

State prosecutors have filed new, more specific invasion-of-privacy charges against two antiabortion activists for secretly recording conversations at national meetings of abortion providers, after a San Francisco judge dismissed most of the initial charges.David Daleiden, leader of a group called the Center for Medical Progress, and an employee, Sandra Merritt, posed as fetal researchers to gain entry to the conventions of the National Abortion Federation in San Francisco in 2014 and Baltimore in 2015.The two said afterward they had been acting as investigative journalists to expose alleged plots by Planned Parenthood and other abortion providers to sell fetal parts.Lawyers for the abortion federation say its members were subjected to harassment and death threats after Daleiden’s group posted edited versions of the recordings online.Attorney General Xavier Becerra’s office charged Daleiden and Merritt in March with 14 counts of violating a California law against recording conversations without consent, in incidents at the San Francisco convention and meetings elsewhere in the state.
